Eligibility
You must be legally capable of entering into a binding agreement to use the Services. The Services are intended for business and professional use and are not directed to children.
Accounts
You may need an account to use certain Services. You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, all activity under your account, and promptly notifying us of unauthorized access or security incidents.
We may suspend or terminate access if we reasonably believe an account is compromised, used unlawfully, or used in violation of these Terms.
Use of the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business or professional purposes.
You must not use the Services unlawfully, interfere with or compromise the Services, bypass security or usage limits, upload harmful code or unauthorized data, facilitate harmful or deceptive activity, infringe third-party rights, or resell access unless we expressly permit it in writing.
Customer Content
"Customer Content" means prompts, instructions, files, source code, data, configurations, metadata, messages, and other content submitted to or generated through the Services by you or your authorized users.
As between you and Metamorph, you retain ownership of Customer Content. You grant us a worldwide, non-exclusive license to host, process, transmit, display, reproduce, and use Customer Content as necessary to provide, secure, support, and improve the Services, comply with law, and enforce these Terms.
You are responsible for Customer Content, including ensuring that you have all rights, permissions, and lawful bases required to submit and process it through the Services.
AI Features and Outputs
The Services may include AI-assisted features. AI-generated outputs may be inaccurate, incomplete, or unsuitable for your use case. You are responsible for reviewing, testing, validating, and approving outputs before relying on them or using them in production.
You should not submit passwords, private keys, production secrets, regulated data, sensitive personal data, or confidential third-party information unless your organization has authorized that use and the relevant feature is appropriate for that data.
We do not guarantee that outputs will be unique, error-free, secure, non-infringing, or fit for any particular purpose.
Software and Desktop Applications
If we provide downloadable software, desktop applications, updates, or installers, we grant you a limited, non-exclusive, non-transferable license to install and use the software solely in connection with the Services and these Terms.
You must not copy, modify, distribute, reverse engineer, decompile, or attempt to extract source code from the software except as permitted by applicable law or open-source licenses.
The software may update automatically or prompt you to install updates. Some features may require an active internet connection, account, subscription, or compatible operating system.
Beta, UAT, and Pre-Release Services
We may provide beta, preview, UAT, experimental, or pre-release features. These features may be incomplete, unstable, changed, suspended, or discontinued at any time. They are provided for testing and feedback and should not be relied on for production use unless we expressly state otherwise.
Third-Party Services
The Services may integrate with third-party platforms, APIs, repositories, cloud providers, model providers, payment processors, analytics providers, issue trackers, and other tools. Your use of third-party services is governed by their own terms and policies. We are not responsible for third-party services, their availability, security, content, data practices, or actions.
Fees and Payment
Certain Services may require payment. Fees, billing cycles, taxes, renewal terms, and cancellation terms will be described at the time of purchase or in an applicable order form. Unless otherwise stated, fees are non-refundable except where required by law or expressly agreed in writing.
Intellectual Property

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Services will be uninterrupted, secure, error-free, accurate, or suitable for your requirements.
Limitation of Liability
To the maximum extent permitted by law, Metamorph will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunities, or business interruption.
To the maximum extent permitted by law, our total liability for all claims relating to the Services or these Terms will not exceed the greater of: (a) the amount you paid to us for the Services giving rise to the claim in the three months before the event giving rise to liability; or (b) USD 100.
Indemnity
You will defend, indemnify, and hold harmless Metamorph, its directors, officers, employees, contractors, and affiliates from claims, damages, liabilities, losses, and expenses arising from your use of the Services, Customer Content, violation of these Terms, or infringement of third-party rights.
Changes to the Services or Terms
We may modify the Services or these Terms from time to time. If we make material changes to these Terms, we will take reasonable steps to notify users, such as by updating the date above, posting a notice, or sending an email where appropriate.
Your continued use of the Services after changes become effective means you accept the updated Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Subject to applicable law, courts located in Delaware will have jurisdiction over disputes arising from or relating to these Terms or the Services.
